II. VEHICLE DELIVERY AND RETURN
2.1 The LESSOR shall provide the rented vehicle to the LESSEE in proper technical condition, with the necessary documents for road use within the territory of the Republic of Bulgaria and with the mandatory equipment required by national regulations and as specified in the Rental Agreement. The delivery is recorded in a mutually signed Handover Protocol, which forms an integral part of the Rental Agreement.
• The LESSEE is obligated to return the rented vehicle with all provided documents and equipment at the agreed time and location, in the same condition as received, during the LESSOR’s business hours as confirmed in the Handover Protocol. The LESSOR’s business hours are from 09:00 to 19:00, Monday through Sunday, excluding national holidays. Otherwise, the LESSEE shall be liable for an additional 'after-hours fee' as agreed in the Rental Agreement.
2.2 If the LESSEE refuses to sign the Handover Protocol upon returning the rented vehicle, the protocol shall be signed by the LESSOR and a witness who attests to the LESSEE’s refusal, and the LESSEE shall be bound by the facts recorded therein.
2.3 The term of the Agreement may be extended with the explicit consent of the LESSOR, provided that the LESSEE pays the additional amount for extending the agreement for the new rental period, no later than the agreed return time.
2.4 In case of failure to return the rented vehicle on time, the LESSEE shall incur a penalty as follows:
- the rental price of the vehicle for 1 (one) day – for delays up to 4 (four) hours;
- the rental price of the vehicle for 2 (two) days – for delays from 4 (four) to 8 (eight) hours;
- the rental price of the vehicle for 3 (three) days – for delays over 8 (eight) hours;
- five times the rental price of the vehicle for each day of delay – for delays exceeding 24 hours. The penalty under this clause is charged for each day of delay, including the first, until the vehicle is returned. A delay of one day is considered as each commenced 24-hour period after the agreed return time. In all cases, the penalty cannot be less than the deposit amount.
2.5 Failure by the LESSEE to return the rented vehicle for more than 24 (twenty-four) hours shall be deemed appropriation/embezzlement, and the LESSOR will notify the competent authorities while reserving all other rights under the Rental Agreement.
2.6 If the rented vehicle is equipped with a tracking system, in addition to all other remedies under the Rental Agreement or applicable law, the LESSOR has the right, without prior notice, to block the engine start and/or take actions to repossess the vehicle in the following cases:
- if the LESSEE has not returned the vehicle within the agreed time;
- if the vehicle crosses the state border of the Republic of Bulgaria without the LESSOR’s prior written consent;
- if the LESSEE engages in reckless driving;
- if the LESSEE repeatedly (three or more times) exceeds the maximum allowed speed;
- if the LESSEE exceeds the maximum allowed speed by more than 30 km/h;
- if the tracking system signal stops transmitting and there is no contact with the LESSEE;
- if information is received from the competent authorities that the rented vehicle is being used by the LESSEE to commit a crime or administrative offense.
III. RENTAL PRICE AND ADDITIONAL FEES
3.1 The rental price of the vehicle is determined based on the daily usage price, and the price for the rental period or total rental price is set according to the rental period.
3.2 The LESSEE shall pay the full total rental price and the fees specified in the agreement upon signing the Rental Agreement.
3.3 The LESSEE may pay the total rental price in cash (subject to regulatory limits on cash payments), by bank transfer, via a POS terminal using a debit or credit card, or through payment platforms. If the payment account provided is owned by a third party (CARDHOLDER) other than the LESSEE, the additional driver(s) or the person signing the agreement on behalf of a legal entity shall be recorded as the cardholder, must be present at the time of rental, and are jointly and severally liable with the LESSEE for all obligations under the Rental Agreement.
3.4 The rental price does not include fuel. Except when the LESSEE has paid a 'Prepaid Fuel' fee, if the vehicle is returned with an incomplete fuel tank, the LESSEE shall pay for the missing fuel at a price specified in Appendix No. 1 to Article 6.15 of these general terms, which is an integral part thereof.
3.5 The rental price includes the value of the mandatory 'Civil Liability' insurance and the vignette fee for the territory of the Republic of Bulgaria – (GTP, GO, vignette).
3.6 All prices and additional fees specified in the Rental Agreement include VAT.
3.7 The rental price does not include the use of additional equipment or services for which additional fees are specified in the reservation or Rental Agreement. Upon payment of the one-time or daily fees specified in the Agreement, the LESSEE is entitled to use additional equipment or services as follows:
- PARTIAL INSURANCE (PI) – Covers damages to the exterior. The LESSEE is responsible only for damages to tires, rims, and windows. If the LESSEE fails to comply with safety regulations (e.g., consumption of narcotics or alcohol) and causes damage to the vehicle, liability is limited to the damage amount. The LESSEE must contact +359 895488499 and notify the police of any accident and obtain a document certifying the event (Protocol). Without such documentation, the insurance is invalid and the LESSEE assumes full responsibility. The PI does not cover interior or exterior shortages or damage to interior elements resulting from improper use or after the use of tobacco, narcotics, or alcohol.
- FULL INSURANCE (FI) – Under full insurance, the LESSEE is not liable for damages to the vehicle. This insurance covers all damages. The LESSEE must contact +359 895488499, notify the police of any accident, and obtain a document certifying the event (Protocol). Without such documentation, the insurance is invalid and the LESSEE assumes full responsibility. The FI does not cover interior or exterior shortages or damage to interior elements resulting from improper use or after the use of tobacco, narcotics, or alcohol.
- WITHOUT INSURANCE – In the absence of insurance and if the LESSEE is not at fault for damages, liability is limited to the deposit amount; however, if damage occurs due to the LESSEE’s fault, liability is limited to the damage amount.
- Additional Driver Fee – The additional driver specified in the Rental Agreement is entitled to drive the rented vehicle. The fee is charged per day for each additional driver.
- Child Seat Fee – The LESSOR provides the rented vehicle with a child safety system in accordance with the Traffic Regulations and applicable norms as specified in the Rental Agreement. The fee is charged per day. Installation of the system is the responsibility of the LESSEE and its cost is not included in the fee. The LESSOR is not liable for transporting children in the vehicle without the mandatory safety systems, nor for damages resulting from the installation.
- Prepaid Fuel Fee – This fee releases the LESSEE from the obligation to pay for missing fuel and penalties when the vehicle is returned with an incomplete fuel tank. The LESSOR is not obliged to refund the value of any available, unused fuel upon return.
- After-Hours Fee – The LESSEE is entitled to receive or return the rented vehicle outside the established business hours (09:00 to 18:00) and on official holidays. This fee is charged as a one-time fee upon signing the rental agreement.
- Delivery/Pick-up Fee – The LESSEE is entitled to receive or return the rented vehicle at a location specified in the Rental Agreement within the municipality indicated by the LESSEE. Delivery or pick-up at other locations shall be arranged individually.
- Mobile Service Team Fee – In the event of a breakdown or other obstacles to the vehicle’s movement, if the LESSEE requests roadside assistance organized by the LESSOR, the LESSEE shall pay the fees specified in Appendix No. 1 to Article 6.15 of these general terms.
If a third party makes a claim against the LESSOR for the period during which the rented vehicle is unlawfully taken outside the Republic of Bulgaria, the LESSEE assumes financial liability for any damages caused due to fault. All additional coverages paid by the LESSEE in such cases are void, and the LESSEE is fully responsible for the damages incurred by the LESSOR.
IV. DEPOSIT
4.1 Upon entering into the Rental Agreement, the LESSEE provides a deposit to secure the performance of their obligations under the Agreement. The deposit is released after the rented vehicle is returned in the condition in which it was provided (as recorded in the Handover Protocol) and after all amounts due from the LESSEE—including but not limited to the rental price, additional fees, expenses, penalties, and compensation for damages—have been paid.
4.2 The deposit may be provided in cash, by bank transfer, through a payment platform, or may be authorized on a credit card belonging to the LESSEE or a third party (CARDHOLDER). If the LESSEE/CARDHOLDER provides credit card details and the deposit is authorized on that card, the LESSEE gives their irrevocable and unconditional consent to the LESSOR that, after the deposit has been fully utilized in the cases provided for in the Agreement—even after its termination—sums exceeding the deposit may be withdrawn. The signature on the first page of the Rental Agreement is deemed as consent for POS terminal transactions. The provided card must be valid until the end of the rental period; otherwise, the LESSOR shall not be responsible for refunding the deposit. In the event of any changes to the provided credit card details, or if required by the servicing bank, the LESSEE must immediately notify the LESSOR. For luxury vehicles [SIPP codes: UFAH, GVAD, LLAH, LFAD, LFAH, OPAD, LEAR], the deposit may only be made by credit card.
4.3 The amount of the deposit depends on the class of the vehicle and is specified in the Rental Agreement.
4.4 In the case of the 'Travel Abroad' option, the deposit is doubled.
4.5 The LESSOR has the right to deduct from the deposit any sums owed by the LESSEE under the Rental Agreement (including rental price, additional fees, penalties, and damages), and the balance will be returned to the LESSEE within one month from the date the vehicle is returned.
4.6 If the Rental Agreement is extended, the remaining deposit will be returned to the LESSEE within the period specified in Article 4.5 after the extended period expires and the vehicle is returned. If the deposit was paid by credit card, it remains at the disposal of the LESSOR for an additional month from the date of return.
4.7 If the rental period is extended, the deposit shall remain at the disposal of the LESSOR for an additional month from the expiration of the extended period and the vehicle’s return.
V. OBLIGATIONS OF THE LESSOR
5.1 In the event that the use of the rented vehicle is impossible or hindered due to a technical fault, the LESSOR is obliged to provide the LESSEE with a replacement vehicle of the same or higher class for the originally agreed period, extended by the time between notification by the LESSEE and the provision of the replacement. The LESSOR is not required to refund any amounts paid under the Rental Agreement if the LESSEE refuses a replacement vehicle of a higher or similar class.
5.2 If the LESSEE has paid an additional 'Full Protection' fee in the event of a traffic accident, damage, incident, or theft of the rented vehicle, the LESSOR is obliged to:
- at its own expense, arrange for the repatriation of the rented vehicle from the incident location;
- provide the LESSEE with a replacement vehicle of the same or higher class for the originally agreed period;
5.3 The provisions of the previous point do not apply when the 'Full Protection' fee is excluded, as set out in these general terms.
VI. OBLIGATIONS OF THE LESSEE
6.1 The LESSEE is obliged to use the rented vehicle for its intended purpose, exercise due care as a prudent owner, maintain it, and return it to the LESSOR in a clean condition without food stains, spills, or other residues and/or waste. The LESSEE must comply with all applicable traffic laws, regulations, manufacturer or supplier instructions, and the requirements of the insurer and the LESSOR.
6.2 The LESSEE must obey traffic rules and pay any penalties imposed by authorities for violations. In cases where applicable law mandates immobilization of the rented vehicle, the LESSEE shall pay the LESSOR, in addition to the rental price for the period, all expenses incurred (including obligations to governmental or municipal authorities and third parties) as well as a penalty equal to three times the rental price for the immobilization period, but not less than the deposit amount.
6.3 Upon leaving the rented vehicle, the LESSEE must not leave behind the key, remote control, registration certificate, insurance policies, or any other documents and portable devices provided by the LESSOR.
6.4 The LESSEE is not permitted to leave or abandon the rented vehicle unlocked or without ensuring that it is parked in an authorized and safe location.
6.5 The LESSEE is not allowed to use the rented vehicle for commercial activities or to transport oversized, bulk, or other goods beyond the manufacturer’s specifications, including animals or cages with animals weighing over 10 kg gross; for towing another vehicle or trailer; for transporting people for payment (including ride-sharing) or for transporting hitchhikers. In case of such violations, the LESSEE shall pay a penalty as specified in Appendix No. 1 to Article 6.15 and Article 6.16 of these general terms for each separate violation.
6.6 The LESSEE is not allowed to use the rented vehicle for participation in training sessions, competitions, rallies, or for driver training. Any violation of this rule will result in a penalty as specified in Appendix No. 1 to Article 6.15 and Article 6.16 for each separate offense.
6.7 The LESSEE is not permitted to sublease or otherwise provide the use of the rented vehicle to any persons not listed in the Rental Agreement. Violations of this rule will result in a penalty as specified in Appendix No. 1 to Article 6.15 and Article 16.6 for each separate violation.
6.8 The LESSEE is not permitted to repair the rented vehicle on their own without the consent of the LESSOR.
6.9 Smoking in the rented vehicle is prohibited. If evidence of smoking is found, the LESSEE shall pay a penalty as specified in Appendix No. 1, which is an integral part of these general terms.
6.10 The LESSEE and any additional driver are not allowed to operate the rented vehicle if they have consumed alcohol and/or drugs or any other intoxicants. In case of violation, the LESSEE shall pay a penalty equal to three times the rental price for the period for each separate offense.
6.11 The LESSEE is obliged to safeguard the keys, documents, and other portable devices of the rented vehicle with the care of a prudent owner.
6.12 In the event of tire damage, the LESSEE must replace the damaged tire with the spare or use the emergency tire repair kit to remedy the damage, then notify the LESSOR and visit the nearest LESSOR office for an inspection. This requirement does not apply under the 'Full Protection' clause unless the exceptions provided in these general terms apply.
6.13 The LESSEE is responsible for fully reimbursing all expenses for repatriation of the rented vehicle and for remedying any technical faults and damages caused by intentional or negligent actions or omissions (including using the wrong type of fuel, ignoring technical warnings, or driving on unsuitable roads).
6.14 The LESSEE shall pay for all deficiencies found in the vehicle, the cost of which is determined based on a document issued by an authorized service center of the respective brand.
6.15 The compensation and penalties due are specified in Appendix No. 1, which is an integral part of these general terms. If repairs are more expensive due to specific paint, brand, model, higher class, or damage not listed in the appendix, the amount shall be determined based on a document from an authorized service center. In addition to damage costs, the LESSEE shall also pay all expenses for roadside assistance or transportation to the incident site and service center, as well as any fines and obligations owed to governmental or municipal authorities and third parties.
6.16 In the event of non-fulfillment of any LESSEE obligations for which no specific penalty is provided in the Rental Agreement, these general terms, or Appendix No. 1, the LESSEE shall pay a penalty equal to three times the rental price for the period, but not less than the deposit amount.
6.17 Regardless of the foregoing, the LESSOR reserves the right to claim from the LESSEE the difference between the total damages incurred (losses and lost profits) and the penalties and compensation due under the Rental Agreement, these general terms, and Appendix No. 1.
VII. TRAFFIC ACCIDENTS, DAMAGES, OR INCIDENTS INVOLVING THE RENTED VEHICLE
7.1 In the event of a traffic accident, damage, incident involving the rented vehicle, or theft, the LESSEE is obligated to:
- take necessary actions to mitigate the extent of the damages;
- immediately call 112, remain at the scene, and provide the necessary assistance to the competent authorities, including reporting all details related to the incident and participating in the preparation of the required documents;
- immediately notify the LESSOR and the insurer of the incident and the actions taken so far, and follow any instructions received.
7.2 In the event of an accident or damage to the rented vehicle, the LESSEE shall bear the costs of returning it to a service center or the LESSOR’s office, unless the LESSEE is released from liability under the Rental Agreement.
7.3 The LESSEE’s liability for damages resulting from an accident, theft, or other incident involving the rented vehicle is limited to the deposit amount only in cases where the 'Full Protection' fee has been paid and no exceptions to this clause apply.
7.4 The limitations or exclusions of the LESSEE’s liability provided for in the Agreement do not apply, and the LESSEE is obliged to fully compensate the LESSOR for all damages and lost profits in each of the following cases:
- if the accident is caused by the fault of the LESSEE/additional driver or the damage results from the negligent actions of the LESSEE or accompanying third parties, or if the accident report states 'mutual fault' or 'undetermined fault';
- if the LESSEE or additional driver operated the vehicle under the influence of alcohol and/or drugs or other intoxicants;
- if the accident or damage was caused intentionally by the LESSEE, the additional driver, or accompanying persons;
- if the LESSEE or additional driver allowed the vehicle to be driven by someone not listed as an additional driver in the Rental Agreement;
- if the accident or damage occurred during or in connection with a crime committed by the LESSEE, additional driver, or accompanying person;
- if the LESSEE fails to fulfill the obligations under Article 7.1 of these general terms;
- in cases of theft or damage to wipers, antenna, tires, trim, mirrors, registration number, additional equipment, keys, or documents of the rented vehicle;
- if there are deficiencies or damages to the interior of the rented vehicle.
7.5 In the event of loss of the vehicle’s documents, registration number, GPS navigation, or keys, the LESSEE shall pay the corresponding penalty as specified in Appendix No. 1 to Article 6.15, which is an integral part of these general terms.
